1. Agreement to Terms
By accessing or using RideSpot ("the Platform"), operated by RideSpot Team ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Platform.
These Terms apply to all visitors, users, and others who access or use the Platform at ridespot.app and related services.
2. Description of Service
RideSpot is a biking and vintage car event platform that connects enthusiasts. The Platform provides the following services:
2.1 For All Users
- Discover and browse biking and vintage car events
- Create a personal profile with vehicle information
- Register for events as a driver or co-driver
- Communicate with event organizers and other participants via messaging
- Receive notifications about event updates and registrations
- Manage vehicle/car profiles for event registrations
2.2 For Event Organizers
- Create and manage events through the event wizard
- Set registration requirements, pricing, and participant limits
- Manage participant registrations and waiting lists
- Communicate with participants via broadcast messaging (including SMS)
- Invite co-organizers to help manage events
- Process payments and manage event finances
- Publish public contact information for event inquiries
3. User Accounts
3.1 Account Creation
To access certain features of the Platform, you must register for an account. Registration is available via email/password or magic link authentication. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Be at least 16 years of age
- Create only one account per person
3.2 Account Security
- Maintain the security and confidentiality of your login credentials
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
- Not share your account credentials with others
3.3 Phone Verification
Certain features, particularly event registration and organizer communication, require phone number verification via SMS. By providing your phone number, you consent to receiving verification codes and event-related communications via SMS.
4. User Conduct
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable laws
- Post false, misleading, or fraudulent content about events or yourself
- Harass, abuse, threaten, or harm other users
- Impersonate any person or entity, or falsely claim affiliation with any person or entity
- Share malicious links or content (links are validated via Google Safe Browsing)
- Interfere with or disrupt the Platform, servers, or networks
- Attempt to gain unauthorized access to any part of the Platform
- Use automated means (bots, scrapers) to access the Platform without permission
- Collect or harvest user data without consent
- Circumvent rate limits or security measures
- Upload viruses, malware, or other malicious code
5. Event Organizer Responsibilities
If you create events on the Platform as an organizer, you additionally agree to:
5.1 Event Management
- Provide accurate and complete information about your events
- Keep event information up to date, including dates, locations, and requirements
- Communicate any changes or cancellations promptly to participants
- Manage registrations fairly and in accordance with your stated policies
5.2 Legal Compliance
- Comply with all applicable laws and regulations for your events
- Obtain necessary permits, licenses, and insurance for your events
- Handle participant data in accordance with GDPR and other applicable privacy laws
- Ensure appropriate safety measures are in place for your events
5.3 Payments and Refunds
- Set clear pricing and payment terms for your events
- Process refunds in accordance with your stated refund policy
- Comply with applicable consumer protection laws regarding cancellations
- Be responsible for any taxes applicable to your event proceeds
5.4 Communications
- Use broadcast messaging responsibly and only for event-related communications
- Respect participant communication preferences
- Not send spam or unsolicited promotional content
- Be aware that SMS broadcasts may incur costs visible to you before sending
6. Event Participant Responsibilities
When registering for events, you agree to:
- Provide accurate registration information for yourself and any co-drivers
- Comply with the event organizer's rules and requirements
- Obtain consent from co-drivers before submitting their personal information
- Honor your registration commitments or cancel in a timely manner
- Maintain appropriate insurance for your vehicle where required
- Follow safety guidelines and instructions during events
7. Payments
Payment processing on the Platform is handled by Stripe, a third-party payment processor. By making payments through the Platform:
- You agree to Stripe's terms of service and privacy policy
- You acknowledge that payment card details are processed directly by Stripe and never stored on our servers
- Refund policies are set by individual event organizers
- RideSpot may charge platform fees as disclosed at the time of transaction
8. Content and Intellectual Property
8.1 Platform Content
The Platform and its original content, features, and functionality (excluding user-generated content) are owned by RideSpot Team and are protected by international copyright, trademark, and other intellectual property laws.
8.2 User Content
By posting content on the Platform (including event descriptions, messages, images, and vehicle information), you:
- Retain ownership of your content
- Grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content in connection with operating the Platform
- Represent that you have the right to post such content
- Agree that we may remove content that violates these Terms
9. Privacy
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Platform, you consent to our data practices as described in the Privacy Policy.
10. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Platform will be uninterrupted, secure, or error-free
- Results obtained from using the Platform will be accurate or reliable
- Events listed on the Platform will occur as described
- Event organizers will fulfill their obligations to participants
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RIDESPOT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, data, use, or goodwill
- Personal injury or property damage arising from events
- Any conduct or content of third parties on the Platform
- Unauthorized access to or alteration of your data
- Event cancellations or organizer failures
This limitation applies regardless of whether the damages are based on warranty, contract, tort, or any other legal theory.
12. Indemnification
You agree to indemnify, defend, and hold harmless RideSpot and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any rights of another party
- Events you organize through the Platform
- Content you post on the Platform
13. Termination
13.1 Termination by Us
We may terminate or suspend your account and access to the Platform immediately, without prior notice, for any reason, including:
- Breach of these Terms
- Fraudulent or illegal activity
- Conduct harmful to other users or the Platform
- Extended periods of inactivity
13.2 Termination by You
You may delete your account at any time through your account settings. Upon deletion, your personal data will be handled in accordance with our Privacy Policy and applicable data retention requirements (e.g., financial records must be retained for 7 years).
13.3 Effect of Termination
Upon termination, your right to use the Platform will cease immediately. Provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions.
For consumers residing in the European Union, you retain any mandatory consumer protection rights granted by the laws of your country of residence.
Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts in Dresden, Germany, unless mandatory consumer protection laws require otherwise.
15. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will:
- Provide at least 30 days' notice prior to any new terms taking effect
- Notify you via email or a prominent notice on the Platform
- Update the "Last updated" date at the top of these Terms
Continued use of the Platform after changes become effective constitutes acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Platform.
16. General Provisions
16.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and RideSpot regarding the use of the Platform.
16.2 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
16.3 No Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
16.4 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
